1. Introduction
These Terms of Service ("TOS") constitute a legally binding agreement between you ("Client," "Customer") and our company ("Company," "we," "us," or "our"). By using our services, you agree to abide by these Terms. If you do not agree, you must cease using our services immediately.
2. Scope of Services
our company provides general contracting and home improvement services, including but not limited to:
Flooring installation (vinyl, floating interlocking flooring, subfloor repairs, waterproofing)
Carpentry & wood rot repair
Window and door installation
Drywall installation and repair
Painting (interior & exterior)
Trim and molding installation
Deck and porch construction/repairs
Home remodeling and renovations
Structural repairs
Custom carpentry and cabinetry
Light electrical and plumbing (as permitted by law)
General handyman services
We reserve the right to refuse or discontinue services at our discretion.
3. Estimates & Contracts
Estimates are valid for 30 days from the issue date.
A signed contract may be required before work begins.
Any changes to the scope of work must be agreed upon in writing and may result in additional costs.

Payment Terms
Payment is due upon project completion unless otherwise agreed upon.
Late payments exceeding 30 days past due will incur a 29.99% late fee of the total overdue amount, with an additional 29.99% charge applied monthly until the balance is paid in full.
Bounced checks will incur a $500 fee in addition to any bank charges or collection fees.
Refunds & Cancellations
Cancellations must be requested in writing at least 48 hours before the scheduled work.
If a project is canceled after work has started, the client is responsible for all labor and material costs incurred.
5. Client Responsibilities
Clients must:
Provide clear and safe access to the job site.
Ensure all necessary permits (if required) are obtained unless otherwise agreed. Permit acquisition may be consulted with us.
Secure personal belongings and remove fragile items from work areas.
Notify us of any known hazards (e.g., lead paint, mold, electrical issues) before work begins.
Failure to comply with these responsibilities may result in project delays or additional costs.
6. Warranty & Liability
Construction Conditions & Client Responsibility
The client acknowledges that construction work is inherently messy and may result in dust, debris, or temporary unclean conditions. These conditions are a normal part of the process, and post-construction cleaning is the client's responsibility.
Our company is not responsible for damage, theft, or injury occurring on-site once work has commenced, including incidents caused by the client or third parties.
Tools, Equipment, & Materials
Any tools, materials, or equipment left on-site when not in active use by our company remain the client's responsibility.
The client assumes full responsibility for ensuring they are not damaged, stolen, or misused by unauthorized individuals.
Unauthorized use of tools, equipment, or materials is strictly prohibited. The client assumes full liability for any resulting injury, property damage, or loss.
Our company is not liable for theft, loss, or damage to tools, materials, or equipment left on-site, except in cases of proven gross negligence.
Workmanship Warranty
We offer a 30-day workmanship warranty on labor unless otherwise stated in a written contract.
Manufacturer warranties apply to materials but are not covered by us.
The warranty is void if modifications or repairs are made by anyone other than our company.
Limitation of Liability
We are not liable for damage resulting from unforeseen structural issues, pre-existing conditions, or acts of nature.
We are not responsible for damages caused by client negligence or third-party interference.
Under no circumstances shall our liability exceed the total amount paid for services.
7. Dispute Resolution & Mediation
Mandatory Mediation Clause
Any disputes must first be resolved through mediation before legal action.
Mediation will take place in Brown County, Texas, or a mutually agreed location.
Each party is responsible for their own mediation costs.
Failure to participate in mediation before filing a lawsuit may result in case dismissal.
Collections & Legal Action
Unpaid balances may result in collections proceedings and/or property liens as permitted by Texas law.
Theft of services (willful non-payment for completed work) may be pursued as a criminal offense under Texas law.
8. Website Access & Legal Restrictions
By using our website or communicating with us, you agree that:
Creditors, debt collectors, or individuals pursuing legal claims against our company, its clients, employees, or subcontractors are prohibited from accessing this site or using its content for litigation purposes.
Engaging with this website constitutes waiver of rights to pursue claims against us, our clients, or our affiliates.
Unauthorized use of this site for legal claims may result in counterclaims.
9. Changes to These Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with an updated "Last Updated" date.
10. Acknowledgment & Agreement
By engaging with our company, including requesting a service, making a payment, or visiting our website, you acknowledge and agree to these Terms.
If you do not agree, you must immediately cease using our services.
Continued use constitutes acceptance of these Terms, including the Mediation Clause and Payment Dispute Policy.
